Delhi Cabinet minister Atishi today made serious allegations against the BJP-led central government, asserting that a significant political conspiracy is underway to impose President's Rule in the national capital. Atishi said, "Arvind Kejriwal's arrest is a political conspiracy to topple his government. We have learnt from reliable sources that in the coming days, the President's Rule will be imposed in Delhi. But imposing President's Rule in Delhi will be illegal and against the mandate of people."

Atishi Reminded SC Decision on President's Rule

Atishi, quoting the recent SC's order, said, "President's rule can be imposed only when there is no other option." Atishi emphasized the apex court's position that such a measure should only be considered when all alternatives for governance have been exhausted, asserting that any move to the contrary would signify political vendetta.


Can President's Rule Imposed in Delhi?

The invocation of President's Rule in Delhi operates within the framework of Article 239AB of the Indian Constitution. This provision grants the Lieutenant Governor (LG) the authority to recommend such action if deemed necessary for the "proper administration" of the national capital. However, the practical implications of governing while incarcerated present significant challenges. Kejriwal's legal status allows him to remain CM, yet navigating the stringent guidelines within the prison system poses obstacles to effective governance.


Clash Between Arvind Kejriwal and LG

The power dynamics between the elected CM and the LG have come into sharp focus amidst Kejriwal's arrest. With authority delegated by the Centre, the LG can recommend President's Rule under Article 239AA if the elected government fails to discharge its duties effectively. Past instances, such as the arrest of Tamil Nadu Minister Senthil Balaji, underscore the ramifications of prolonged legal battles on political leadership.

Alternative Solutions for Delhi

One potential resolution lies in the LG's authority to convert a building into a prison, enabling house arrest for continued engagement in governance. However, cooperation between Kejriwal and the LG is essential, presenting logistical and political challenges.


Union Home Ministry Keeping a Close eye:

Meanwhile, the Union Home Ministry is reportedly examining the implications of Kejriwal's refusal to resign and his continuation as chief minister. Legal experts suggest that the Centre may suspend or remove him from the post, following procedures applicable to arrested government officials.

Govt won't be run from Jail: LG's Reassurance

Earlier last month, speaking over Arvind Kejriwal's arrest, Delhi Lieutenant Governor V K Saxena said that the government will not be run from jail. Speaking at the Times Now Summit, Saxena emphasized, "I can assure the people of Delhi that the government will not be run from jail."
